Q: I am (M. S. S.), of Yemeni nationality, and I have a younger brother. I want to marry my cousin, but my younger brother was breastfed by the cousin I want to marry. Is she forbidden to my brother and to me in marriage, or is she forbidden only to my younger brother? Please inform us about this issue, and may Allah reward you with good.
A: The breastfeeding that results in prohibition is that which occurs five times or more within the first two years. A breastfeed is defined as: the child holding the breast and sucking milk from it, then releasing it. If he returns to it and sucks milk from it again, it is counted as the second time, and so on. Therefore, if your brother was breastfed by the aforementioned woman five times or more within the first two years, as described, it is forbidden for him to marry her. Allah the Exalted said:
Prohibited to you [for marriage] are your mothersحُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ
[An-Nisa 4:23]
up to His saying:
your [milk] mothers who nursed you, your sisters through nursingوَأُمَّهَاتُكُمُ اللاتِي أَرْضَعْنَكُمْ وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ
[An-Nisa 4:23]
the verse, and He said:
Mothers may breastfeed their children two complete years for whoever wishes to complete the nursing [period].وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَنْ يُتِمَّ الرَّضَاعَةَ
[Al-Baqarah 2:233]

and the Prophet (peace and blessings be upon him) said:
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful.يحرم من الرضاع ما يحرم من النسب

It is agreed upon as authentic. It is also established from Aisha (may Allah be pleased with her) that she said: "Among what was revealed in the Qur'an was: 'Ten known breastfeeds prohibit [marriage],' then it was abrogated by: 'Five known [breastfeeds].' The Messenger of Allah (peace and blessings be upon him) passed away while the matter was still as it was." If his breastfeeding from her was less than that, or occurred outside the first two years, it is permissible for him to marry her. As for you, it is permissible for you to marry her, whether your brother was breastfed by her a little or a lot. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
