Fatwa No. ( 7206 )
Q: A dispute arose between me and my brother over problems concerning the children. In reality, they were not major problems, but I became extremely angry because my brother used foul language directed at me. I swore to cut off relations with him and declared my wife, my children, and everything I own forbidden, and that I would not follow his funeral so that I would not speak to him or mix with him again. All of this happened in a state of anger. Now I find that with this oath I have strayed from the teachings of Islam, which require us not to sever family ties. I am approaching you to offer us a helping hand.
A: First: severing family ties is one of the major sins; because the Prophet (peace and blessings be upon him) said:Sunan Abi Dawud 1696Sahih (Al-Albani) narrated by Muslim. And his saying: Sahih Muslim 2555 . narrated by Muslim. And swearing an oath to sever family ties is an abhorrent statement. And forbidding what Allah has made lawful of wives and the good things of wealth: is forbidden and an encroachment upon Allah, so you must repent to Allah and seek His forgiveness for what occurred from you of severing family ties, and your oath regarding it, and your forbidding of what Allah has made lawful for you, and you must regret what has passed, and maintain your family ties and meet your brother's evil with good; perhaps Allah will accept your repentance and forgive you. Second: if you return to maintaining ties with your brother, then you must pay an expiation for an oath for
the oath to cut off relations with him, which is feeding ten poor people, or clothing them, or freeing a believing slave. If you cannot do that, fast for three days. Third: If you intended by declaring your wife forbidden to prevent yourself from maintaining ties with your brother and to confirm cutting off relations with him, and not to divorce your wife or declare her forbidden - then you must, if you maintain ties with him, pay another expiation for an oath; which is as mentioned above. As for your wealth, it is not forbidden to you by what you mentioned. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
