Q: I found a hadith in a book titled (The Book of Major Sins) in the chapter (Undutifulness to Parents) which indicates that the maternal aunt holds the status of the mother. Please inform us about the maternal aunt who holds the status of the mother: is she the mother’s sister or the father’s wife? Because I have become confused about this. My hope is in Allah, then in you: which one holds the status of the mother?
A : The hadith regarding the maternal aunt holding the status of the mother is authentic, narrated by al-Bukhari and Muslim from 'Ali ibn Abi Talib (may Allah be pleased with him) from the Prophet (peace and blessings be upon him). The intended meaning in the hadith is: the mother’s sister by blood, and the father’s wife is not intended. The meaning of the hadith is: that the maternal aunt by blood holds the status of the mother in the custody of her children when she is absent. As for calling the father’s wife a maternal aunt, it is the custom of some people, and it is not a legal term.
