Q2: I was surprised to find my wife swearing by Allah that she would fast for two months if she succeeded, and I got angry with her because I said: She must seek my permission. 1 - Is she obligated to fast for two months without my consent? 2 - Is she obligated to pay an expiation for the oath? 3 - She suffers from asthma and breaks her fast on some days in Ramadan because of it, contrary to a valid legal excuse. Is she obligated to fast this vow?
A2: If the situation is as described, she is not obligated to fulfill her oath; because
fasting would weaken her from performing her duties toward her husband’s interests, and would deprive him of his right over her, especially the right to enjoy her companionship. This is indicated by what Abu Hurayrah (may Allah be pleased with him) narrated, that the Messenger of Allah (peace and blessings be upon him) said:Sahih al-Bukhari 5195 It was narrated by al-Bukhari and Muslim in their (Sahihayn). Therefore, in her case, the expiation for the oath becomes emphasized, which is: feeding ten poor people, giving each poor person one and a half kilograms of the staple food of the land, or clothing them, or freeing a believing slave. If she is unable to do that, she must fast for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
