Q 4: What is your opinion of one who says that it is not forbidden to approach a woman who is not in the protection of a man, and that only the woman who is in the protection of a man is forbidden, which is what is called (zina)?
A 4: One who says that is a disbeliever by the consensus of the Muslims; due to the generality of the Qur'anic text regarding both matters, and the explicit statement of the Sunnah prohibiting both and naming them zina, and specifying the punishment for each. Allah the Exalted said:
And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way.وَلاَ تَقْرَبُوا الزِّنَا إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلا
[Al-Isra 17:32]
And He said:
The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashesالزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ
[An-Nur 24:2]
the verses. And the Prophet (peace and blessings be upon him) said:
Receive (teaching) from me, receive (teaching) from me. Allah has ordained a way for those (women). When an unmarried male commits adultery with an unmarried female (they should receive) one hundred lashes and banishment for one year. And in case of married male committing adultery with a married female, they shall receive one hundred lashes and be stoned to death.خذوا عني خذوا عني، قد جعل الله لهن سبيلاً، البكر بالبكر جلد مائة ونفي سنة، والثيب بالثيب جلد مائة والرجم
