Q: A brother who is seventeen years and five months old
approximately, caused the death of a boy by running him over with a car. This boy was approximately thirteen years old. This happened on Thursday, corresponding to 4/10/1403 AH, unintentionally. The traffic liability was 50% because he did not act in a better way to avert the accident. The private right was settled by the deceased's family relinquishing their claim religiously without compensation, counting it as a good deed with Allah. The question is: My brother has resolved to fast two months starting from the beginning of this month, Muharram, in the year 1403 AH. The month of Hajj, the blessed Day of 'Id al-Adha, will fall in his second month. Will he break his fast on the Day of 'Id—meaning only that day—and then make it up, or will he continue fasting? And does he have to adhere to the days of the month according to the calendar, or does he complete sixty days?

A: He must break his fast on the Day of 'Id al-Adha and add one day after the two months in its place. This does not break the continuity. The obligatory fast for the expiation of killing is only two months, as Allah the Exalted said:
then [instead], a fast for two months consecutivelyفَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ
[An-Nisa 4:92]
, and the basis for fasting it is the sighting of the new moon, not the calendar.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
