Q: I am a man, and Allah willed that a car accident happen to me, and my mother and my daughter (may Allah have mercy on them) died in this accident. The question is: Is it permissible for me to make up the fasts and perform Hajj in this year? And is it permissible for me, if I start fasting, to fast while I am a pilgrim?
Hajj does not prevent fasting for the expiation of accidental killing, and combining them is permissible. If fasting for expiation is interspersed with the days of Hajj, it is forbidden for you to fast on the Day of Sacrifice, which is the tenth day, and the three days after it, which are the Days of Tashriq; because it is obligatory to break the fast on these days, based on what is authentic from the Prophet (peace and blessings be upon him) that he forbade fasting on them. Breaking the fast on these four days does not break the continuity of the fast. So if you fasted for the expiation before the Day of Sacrifice, you must complete the fasting after the Days of Tashriq for sixty days for every soul that died with you in the aforementioned accident, if you were liable for the accident or a portion of it. And if you wish to start fasting after performing Hajj, that is permissible for you, and it is better; because of the proximity of the time of Hajj, and so that you can break the fast on the day of 'Arafah ; because it is better for the pilgrim not to fast on the day of 'Arafah so that he can strengthen himself for worship, supplication, and remembrance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
