Q: Twenty-two years ago, I went with my husband and some of my children to perform Hajj, and I was four months pregnant. On the night of 'Arafah, we carried our luggage, and due to the large quantity and weight of the items, I felt pain in my stomach. That same night, the fetus miscarried, and I buried it without washing it or praying over it. I was at the end of the fourth month, and I had been experiencing bleeding since the month of Dhul-Qa'dah. After the fetus miscarried, post-natal bleeding came out of me and continued until the end of the Hajj rituals. Question: Do I owe anything for the miscarriage of the fetus during this period? I did not wash it, did not pray over it, did not inform anyone of it, and it did not happen by my will. Is my Hajj valid? I performed all the rituals, including the Tawaf of Ifadah, while I was in a state of post-natal bleeding, and I was ignorant of all these matters.
Please inform me, may Allah reward you with good.

A: If the situation is as you described, that the pregnancy was in the fourth month and had not completed four months, then you owe no expiation for the miscarriage of this fetus, because the soul was not breathed into it during this period. Consequently, it is not named, not washed, and not prayed over. However, you are sinful for causing the miscarriage of this fetus, so you must repent and seek forgiveness for what happened from you, and not return to such an action in the future. As for your Hajj, if you were performing Ifrad or Qiran and you performed Sa'y with the Tawaf of Arrival, then you are required to perform the Tawaf for Hajj only. So you return to Makkah and perform Tawaf with the intention of the Tawaf of Hajj. If you did not perform Sa'y with the Tawaf of Arrival, or if you were performing Tamattu', then you are required to return to Makkah and perform Tawaf with the intention of the Tawaf of Ifadah, and perform Sa'y afterwards. This is because Tawaf requires ritual purity, so your previous Tawaf while in a state of post-natal bleeding is not valid for you. If your husband had intercourse with you before you made up the Tawaf of Hajj, then you are required to sacrifice a sheep that is acceptable as an 'Id sacrifice, to be slaughtered in Makkah and distributed to its poor, for the sake of having intercourse, which is one of the prohibitions of Ihram before the second state of release from Hajj. And when departing from Makkah , you perform the Farewell Tawaf.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
