Q: A woman went for Hajj and performed the rituals, intending to combine the Tawaf al-Ifadah with the Tawaf al-Wada'. However, she started menstruating on the 10th of Dhul-Hijjah. Fearing she would miss her group, she performed the Tawaf with the caravan at the end of Hajj, before departure, while she was in a state of impurity, because she was unable to remain in Makkah al-Mukarramah . What is required of her now, and is her Hajj valid? If she is required to repeat the Tawaf al-Ifadah, when should she repeat it, i.e., at what time of the year? And if she is unable to go to Makkah , what is required of her?
A: First: The Tawaf she performed is not valid; because she performed it while menstruating, and one of the conditions for the validity of Tawaf is purity from major and minor ritual impurity.
Second: It is obligatory for her to return to Makkah and perform the Tawaf al-Ifadah. As for Sa'y, if she had entered the state of Ihram as a Qarinah or Mufridah and performed Sa'y after the Tawaf al-Qudum, then she owes no Sa'y. But if she had not performed Sa'y, or if she was a Mutamatti'ah, then she must perform Sa'y after the Tawaf. Third: If she is married and her husband had sexual intercourse with her during the period between the first Tawaf and the last Tawaf, then she must slaughter a sheep that is acceptable as an 'Id sacrifice and distribute it to the poor of the Haram in Makkah ; because she committed a prohibited act among the prohibitions of Ihram. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
