Q: I am a woman who was pregnant in my ninth month about twenty-four years ago from this date. You know that women in that time did many tasks, and I was leveling a pile of dirt in a room in our house, and I had three of my children. When I felt tired and annoyed by the children, I threw the shovel at the dirt without any intention on my part. Then the stick fell back on me and struck me lightly on my belly. After that, I remained for a week without feeling the movement of the fetus. Then I gave birth to a dead female child, and there was a deformity in her head. I do not know if it was from that or a congenital deformity. Please inform us, may Allah reward you: What do I do? I am an elderly woman suffering from diabetes and a chest operation. I have returned [to the hospital] once, and I have an appointment at the hospital to repeat the operation, but I postponed it to find out if I owe anything or not? And what is the method of freeing a slave? Because I desire to free a slave if I owe anything? May Allah reward you with good.
A: It is obligatory for her to pay the expiation; because she was the cause of its death. The expiation for accidental killing is: freeing a believing slave. If she cannot do so, she must fast two consecutive months, sixty days. And if she is unable to perform the expiation, it remains a debt in her conscience until she is able to perform it.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
