Q: We inform your Eminence that I have a full brother who is seven years old. I was driving a car and reversed it, and he was riding on it, clinging to the car and hidden from my view. I asked him, “Did you get off?” before I reversed, and he said to me, “Yes,” and he lied to me. Therefore, Allah willed that I hit him with the car from behind, and he was crushed against a plow that was standing there, without my intention, and his leg was broken. After fifteen days, he died in the hospital. Please inform us, may Allah reward you with good: Do I have to fast for two months, or free a slave, or pay blood money?
A: If the situation is as you described, then the expiation is upon you; because you were negligent in not ensuring that your young brother had gotten off from behind the car. The expiation is freeing a believing slave. If you do not find one, then you fast for two consecutive months, sixty days, along with repentance to Allah the Exalted.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
