Q: I was pregnant in my ninth month, and I felt some pains that required me to go to the hospital. The specialist doctor informed me that a quick surgical operation was needed to save the fetus, as natural delivery was not possible. I refused the operation, and the doctor informed me that if I did not agree to the operation with this speed, it would be dangerous for the fetus,
and it might even face death. In fact, it died in my womb after a few days. Your Eminence, Shaykh: Is there a sin on me for that, and do I consider myself to have caused its death due to my refusal of the operation that would have been a rescue for its life threatened by danger, by the will of Allah, according to the doctors' report? And does that obligate me to perform expiation by fasting two consecutive months? Please inform us, may Allah reward you with good.

A: If the situation is as mentioned in the question, then you owe nothing regarding the death of the fetus; because leaving the operation is not considered negligence in its life or a cause of its death; and because the operation may not achieve the intended result mentioned by the doctor, and the original presumption is the innocence of the conscience, and praise be to Allah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
