Q: I am the owner and driver of a car. I stopped it and got out to attend to a necessary matter, leaving it running without turning it off or securing it to keep it in place. That was
Except for my negligence and forgetfulness, and the car rolled over, and there was a small, innocent child behind it, and as a result, it took the child's life, so what is the ruling in this case? And does this fall under the ruling of accidental killing as specified in the Book? And if the ruling falls under accidental killing, then take note of an explanation of my situation: To the extent of my ability and the hardships of my life, I am a poor man with no money; insolvency has persisted with me to the point that it is sometimes difficult for me to obtain food for the children. He has authority in this matter and wisdom in all circumstances. This is from one aspect, and from another aspect: I am suffering from kidney failure that has wasted my body, so I have no ability to fast two consecutive months due to the suffering of the illness, and I endure it with all patience and faith. The doctors have advised me to break my fast due to my suffering from the hardship of the illness. So in both cases, I am unable to free a slave, nor do I have the ability to fast. I am now confused about my matter, regarding the expiation for my sin, so what should I do in this situation? I ask you to answer me in a way that reassures my soul, settles my eye, and calms my mind regarding the acceptance of my repentance.
A: If the matter is as you described, it is obligatory for you to pay the expiation for accidental killing because you caused the death of the aforementioned child. The expiation is: freeing a believing slave. If you cannot find one, then fast two consecutive months. If you are unable to do that, it remains upon you until you are able to perform the expiation; because this is a right of Allah (Exalted and Majestic is He). If you are unable to do it in this life, we hope that Allah will forgive you.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
