Fatwa number ( 15090 )
Q: Eighteen years ago, when I was 15 years old, I went out with my father, and we had two brothers with us: one was about 4 years old, and the other was slightly older than him, and we had some sheep with us. After we had moved a short distance from the house, my father said to me: I will return to the house, and it is obligatory for you to stay with the sheep and your brothers. So we stayed, and after a while, we left our place to catch up with the sheep. The little boy lagged behind us, and I saw him standing there. Then he turned as if he wanted to return to the house, without us saying anything to him or him saying anything to us. I was seeing him at that time, and then we disappeared from his sight with the sheep,
and we stayed for several hours. Then we returned to the house and did not find him there. So we went out with my father and some people to search for him. We found that he had walked a long way from the house and was exhausted from walking, and we found that he had passed away to the mercy of Allah. The question: Does sin attach to me for leaving him, and do I owe an expiation? Answer us, may Allah guide you to what He loves and is pleased with.

A: If the matter is as described, then you owe an expiation for your negligence in caring for your brother, which was not taking him with you and bringing him to the house, along with repentance to Allah the Exalted for that. The expiation is freeing a believing slave, and if you do not find one, then fasting for two consecutive months, which is sixty days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
