Q: I am a woman in my fifties. Thirty years ago, during my second pregnancy, in the ninth month, I was afflicted with a severe cough. One of my neighbors advised me to take a little pepper and put it in my tea to get rid of this cough. I actually used this remedy hoping to be cured of this illness, but it happened that I was struck by severe cramps, which resulted in the fetus falling and dying . Since we were living in the desert and there was no one to prescribe us the correct treatment, I ask Allah, then you, to answer my question in writing as soon as possible. Do I have to pay an expiation or not? I offer you my sincere prayers, and may Allah protect us and care for you.
A: You must pay the expiation for accidental killing; because it appears that its falling and death were due to your use of pepper. The expiation is: freeing a believing slave, and if you cannot find one, then fast for two consecutive months, sixty days. We ask Allah for your help and success, and that He make your child an intercessor who is granted intercession. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
