Q: I inform your Eminence that I am a young man, 31 years old. My elder brother passed away eight years ago, leaving behind four children and a wife—who is our cousin’s daughter. Out of my desire to raise my brother’s children and not expose them to what might result from the marriage of their young mother, I relied upon Allah and married her; so that I could provide her and my brother’s children with a dignified life under our family, with whom we live. We have never separated, and this was the only solace for my father after the death of my brother (may Allah have mercy on him). Praise be to Allah, she was a righteous wife, but Allah willed that a hereditary condition appear in our family, which results in the death of the newborn after one or two months at the latest estimate. I buried our last newborn about a month ago, and he was the third to meet the same fate.
And due to my need for righteous offspring who might help me in life as I grow older—if Allah rectifies my affairs—and my inability to marry another woman because I cannot afford the necessary expenses for another family due to the modesty of my salary, I consulted the hospital with the aim of finding appropriate treatment. This was due to our severe psychological suffering during the months of pregnancy, as well as after birth, and when Allah’s decree befalls our children, which we cannot avert. The doctors’ final opinion was to consult the specialized hospital in Riyadh upon the occurrence of pregnancy to take a sample from the fetus in its mother’s womb and determine whether it is healthy or afflicted with the same disease. If it is healthy, we continue the pregnancy; if it is afflicted, the fetus is aborted, and this is after seeking our consent, if the Shari'ah permits it, especially since this will be done before the fourth month. My question to your Eminence, may Allah preserve you, is: To what extent is the procedure of abortion permissible in a case like ours, which has no solution? I cannot divorce my cousin, nor can I displace my brother’s children, and I cannot marry another woman due to my inability to do so, as I previously informed your Eminence. Please inform us, may Allah reward you. A: It is not permissible to abort the fetus merely on the basis of the doctors’ statement that it is afflicted with a disease. Rather, the matter is left to Allah (Glorified and Exalted is He). We advise you both to ask Allah for well-being from all evil, with good opinion of Allah (Glorified and Exalted is He), and be glad with good news and a good outcome, if Allah wills.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
