Q: He divorced his wife in the month of Sha'ban by saying to her: “You are divorced, and in the neck of Satan you are entangled, forbidden to me and lawful to others.” Fifteen days after my divorce, I took her back, and he mentioned that he had not divorced her before that, and his divorce was not for compensation. He asks about the validity of his taking her back?
A: If the matter is as the questioner stated, that he divorced his wife by saying to her: “You are divorced, forbidden to me and lawful to others,” then this is considered one divorce. Since he mentioned that he had not divorced her before that, and his divorce was not for compensation—if the matter is as he stated, then his divorce is revocable, and he has the right to take back his divorced wife as long as she is in the waiting period. If his taking her back is established and it was before she exited the waiting period, then his return is valid, and she remains with him with two divorces. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
