Fatwa number ( 15691 )
Q: I was in a state of extreme anger, and I was talking at my workplace—not my home—with a colleague of mine, and I said to him: Listen, so-and-so: (My wife is forbidden to me like my brother and my sister if so-and-so enters this country and works in that company) meaning: that I would be the cause of bringing him in and enabling him to work in the institution where I work. The purpose was not to cause him harm, but to protect him from harm that would be inflicted on him by another colleague of mine at work. Now, my dear brother: What is the ruling of the Shari'ah if I want to retract what I said and enable this person to enter this country and work in that institution? This is contrary to what I swore to, as I explained to you previously. Knowing that my family and I follow the school of Imam Malik (may Allah have mercy on him), and if there is an expiation, for example, what is its amount and how is it performed? I remind you that when I swore, the intention was not to deter anyone or to aim to end a particular problem, and my wife was not involved in my conversation or present with me, since, as I explained to your eminence, I was at work,
and she has no knowledge of this matter to this day. I am eagerly awaiting your reply and your fatwa.

A: If the matter is as you described, you must pay the expiation for zihar if you break your oath by bringing the worker in and having him work in the aforementioned company. The expiation is: freeing a believing slave. If you cannot find one, then fast for two consecutive months. If you are unable to do so due to illness or old age, then feed sixty poor people. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
