The first question of Fatwa number ( 1782 )
Q1: If a guest is hosted by a person and the guest fears that the host will burden himself for his sake, and he says: “I swear by divorce, or I swear by prohibition, that you will not slaughter,” and then the host slaughters, what is the ruling?
A1: If the situation is as described, then if one swears by divorce or prohibition
that his host will not slaughter for him out of fear of burdening himself, and then the host slaughters, he must pay the expiation for an oath. This is done by feeding ten poor people, with five sa' (a dry measure of about 3 kg) of wheat, dates, rice, or the like, from the mid-grade food he feeds his family, and distributing it among ten poor people. Or, if he wishes, he may clothe ten poor people or free a believing slave. If he is unable to do so, he must fast for three days, and it is recommended that they be consecutive, based on the saying of Allah the Exalted:
(87) O you who have believed, do not prohibit the good things which Allah has made lawful to you and do not transgress. Indeed, Allah does not like transgressors. (88) And eat of what Allah has provided for you [which is] lawful and good. And fear Allah, in whom you are believers. (89) Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy peopleيَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللَّهُ لَكُمْ وَلاَ تَعْتَدُوا إِنَّ اللَّهَ لاَ يُحِبُّ الْمُعْتَدِينَ (87) وَكُلُوا مِمَّا رَزَقَكُمُ اللَّهُ حَلاَلاً طَيِّبًا وَاتَّقُوا اللَّهَ الَّذِي أَنْتُمْ بِهِ مُؤْمِنُونَ (88) لاَ يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ
[Al-Ma'idah 5:87-89]
