Q: I am a young man from the Arab Republic of Yemen . It happened that I was bewitched away from my wife two and a half years ago, and this was done by her two brothers. They put this sorcery in a great whirlpool, affecting neither me nor my wife, and among its most significant effects was the occurrence of intense hostility between me and her. This hostility made my wife forbid herself to me, and she is not aware of this. So that I do not lengthen the explanation, because the harm and effects of sorcery on the human mind are known to every person, I divorced my wife because I could not bear the great calamity I was in, nor the anxiety I was experiencing. Yes, I say this because this hostility and hatred reached its limit. The divorce took place as follows: When the one who wrote the divorce came, he said: Do you want to divorce? I said: Yes, because of the anxiety I am in. He said to me: Say, "I have forbidden her as I have permitted her." I said so, and he brought the wife and said, "I have forbidden her as I have permitted her," and she did not say anything else. Now, after my psychological treatment and after my wife was treated by her family, we want to return to each other, but this causes obstacles that are insurmountable for people who do not appreciate or understand what we went through. It was from her family. I say this truthfully because they are purely rural, Bedouin villages. Therefore, I ask that after reviewing my problem, you issue a fatwa on this matter.
A: If the situation is as you described, consider what happened to you of
forbidding her as one divorce. You may take her back as long as she is in the waiting period. If she has exited the waiting period, you may return to her with a new contract and a new bridal gift, with her consent, unless this divorce was the third of three divorces. In that case, she is not lawful to you until she marries another man and he has intercourse with her, and then he dies or divorces her. Once her waiting period ends, you may marry her with a new contract and a new bridal gift, with her consent, after she has exited the waiting period. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
