Q: Seventeen years ago, my wife became pregnant and then miscarried at three months. One of the women who was present at the miscarriage threw the fetus along with the placenta into the trash, and I was not aware of this. Do I or my wife owe an expiation? Please inform us, may Allah reward you with good.
A: It is not clear to us from the question whether the abortion was intentional or not. Accordingly, if it was not intentional and the miscarriage occurred in the third month—that is, before the soul was breathed in—and you threw it in the trash, then no legal consequence follows from this action, neither an expiation nor anything else. However, if the abortion of the aforementioned pregnancy was intentional and it was in the third month before the soul was breathed into it, then she has
committed a sin in that, and she must repent to Allah (Glorified and Exalted is He) from it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
