Oaths and Marital Defiance

Fatwa No. ( 21418 )
Q: I am married to two women, and I have sons and daughters from each of them, praise be to Allah. I wish to give one of them a house, as she is from a foreign country, knowing that she has obtained Saudi citizenship and has no
relatives in the Kingdom. Can I register a house in her name? Please inform me, may Allah protect you and reward you. Amen.

A: It is obligatory for the husband to be just between his two wives, or his multiple wives, in what he is able to do. As for what he is not able to do, justice is not obligatory upon him. Giving one of the two wives a house while not giving it to the other is something the husband is able to do, so it is not permissible for him to do so. The question did not mention a legitimate legal justification that would make this permissible. The basis for this is his saying (peace and blessings be upon him):
O Allah, this is my division concerning what I control, so do not blame me concerning what You control and I do not.اللهم هذا قسمي فيما أملك، فلا تلمني فيما تملك ولا أملك
Sunan Abi Dawud 2134
narrated by the five except Ahmad . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
