Q8: Regarding the proposal and the marriage contract, there are local customs practiced by the Malikis at the time of the proposal and the contract, such as distributing flowers, and fruit that is eaten and is not forbidden, or distributing salt according to the tribes, in order to spread the news of the proposal or the contract among people, where everyone to whom salt or flowers are given shares the news. The Hanbalis forbid this; because the Messenger of Allah (peace and blessings be upon him) did not do such a thing, but only distributed dates, and likewise all that relates to local customs is considered a religious innovation
A8: The marriage contract is established by the legal formula, which is the offer from the guardian or his agent, and the acceptance from the husband or his agent, and this is done in the presence of two just witnesses. It is not prescribed to distribute any of the fruits or
other items, nor to bring any flowers; because this has no basis in the Shari'ah, and what is prescribed is to hold the wedding feast at any suitable time; due to the saying of the Messenger of Allah (peace and blessings be upon him) to the newlywed: . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
