Q: I proposed my brother’s (S. M. A.) daughter to one of my sons, and he gave her to him, but he postponed the marriage contract to another time. After that, I traveled to the city of Riyadh for twenty days, and before my return, he proposed her to
another person and married her to him. I am his uncle, and I was not satisfied, and I was waiting for the time he had mentioned. The conditions of the proposal, O Your Eminence, included that no one should propose her before him; therefore, we hope for your Eminence’s guidance: Is it permissible to propose a marriage over another’s proposal, and what are the procedures that result from that? May Allah preserve you and guide your steps to what is good.
A: It is not permissible for a Muslim to propose a marriage over the proposal of his Muslim brother; for it is established from Ibn 'Umar (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said:Sunan an-Nasa'i 3240Sahih (Darussalam) Agreed upon by al-Bukhari and Muslim.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
