Q1: A man hired a Muslim maid, and when her term ended, he traveled with her from Tabuk to Jeddah alone. In Jeddah , she asked him to take her for 'Umrah; because she is traveling outside Saudi Arabia , and she does not know if she will return or not. He went with her and she performed 'Umrah, then he returned her to Jeddah . She traveled to her family and he returned to his family. He asked about: A - Is it permissible for him to travel with her alone? B - Is her 'Umrah valid or not? And does she have to perform 'Umrah again since she was without a mahram or not?
Q1: It is not permissible for her to travel without a mahram; for it is narrated by al-Bukhari and others, that the Messenger of Allah (peace and blessings be upon him) said:
It is not permissible for a man to be alone with a woman, and no lady should travel except with a Muhram (i.e. her husband or a person whom she cannot marry in any case for ever; e.g. her father, brother, etc.)." Then a man got up and said, "O Allah's Messenger (ﷺ)! I have enlisted in the army for such-and-such Ghazwa and my wife is proceeding for Hajj." Allah's Messenger (ﷺ) said, "Go, and perform the Hajj with your wife."لا يخلون رجل بامرأة، ولا تسافرن امرأة إلا ومعها محرم، فقام رجل فقال: يا رسول الله: اكتتبت في غزوة كذا وكذا وخرجت امرأتي حاجَّة، قال: اذهب فاحجج مع امرأتك
Sahih al-Bukhari 3006
. As for her 'Umrah that she performed without a mahram, it is valid, but she has sinned by traveling without a mahram, and she must repent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
