Q1: I have a brother who is mentally retarded, meaning: he is not obligated by the rulings of the Shari'ah. He handles my affairs, such as bringing me things from the market and other items. He enters the house where my wife is and leaves.
What is obligatory regarding him? Does my wife have to observe hijab in front of him or not? Knowing that she is wearing a niqab and he sees her face.
A1: It is not permissible for a man to enter upon a woman who is not one of his mahrams while she is alone in the house, even if he is mentally retarded; because of the saying of the Prophet (peace and blessings be upon him):Jami` at-Tirmidhi 1171Sahih (Darussalam) , and his saying (peace and blessings be upon him): Musnad Ahmad 177Sahih (Darussalam) , narrated by the Imam Ahmad with a sound chain from 'Umar ibn al-Khattab (may Allah be pleased with him). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
