Fatwa number ( 21333 )
Q: My father passed away on Friday, 11/12/1420 AH. He left behind a full brother who is about sixty years old or slightly more. He is currently living with my mother, my brother, and my sister in one house. I would like to inform you that this uncle’s situation is as follows: 1 - He is a person who, in the expression of the common people, is "on his intentions," meaning: he does not like to interfere in the affairs of others, and he has not been given the ability to argue or keep up with many people. However, he is not insane or mentally ill; he is a sound person. b - And the point worthy of mention is that he previously got married, but this marriage was not destined to last, as that wife requested khul' (divorce at the wife's request for compensation). She went to the judge and explained the situation, and it became clear to the judge that he had absolutely no desire for women—meaning my uncle. So the judge granted her khul' from him without a waiting period or mourning for her. This khul' was not a recent development; this condition has been known about him for many years of his life. The question is: My mother is currently in the mourning period due to the death of my father (may Allah have mercy on him). Is it permissible for my mother to treat this uncle as one of those men who have no sexual desire, or as a child, or even as some of the mahram (relatives one may not marry), or must she treat him as a complete stranger? Knowing that seclusion is completely absent due to the presence of her sons or some of them. And the same applies to my wife: does she treat him as my mother treats him?

A: Your mother and your wife must consider the aforementioned uncle a stranger to them, so they must observe hijab (the covering prescribed for women) from him, and neither of them may be alone with him in a place, whether your mother is in the mourning period of widowhood or otherwise. He is not among those who are not of sexual desire, because he previously got married, and the fact that he was not successful in that marriage does not make him one of those who have no sexual desire. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
