Q: I have been married to my wife for approximately 15 years and have not had any children from her. For this reason, I married another woman and had children from her, praise be to Allah. This is not the main issue, but my issue is: We live in one house with a system of two apartments, and our meals are shared without any problems, praise be to Allah. However, my heart leans toward my first wife, just as the heart of the Messenger of Allah (peace and blessings be upon him) leaned toward the Mother of the Believers A'ishah (may Allah be pleased with her). However, the nature of jealousy exists in both wives, though it rarely shows on them. I do not control their hearts, and I am unable to do what the Prophet did with his wives, and my wives are not like the wives of the Prophet (peace and blessings be upon him). I take as evidence that justice is equality in financial maintenance, lodging, and housing, and as for the rest of the matters, as long as they do not fall under the Shari'ah, I am unable to give much justice in them. I hope for a reward in answering the following: 1- Do I have a sin due to the lack of justice in the other matters?
2- If I have a sin, what are the limits of justice? 3- What are the matters in which leaning toward one of the wives is permissible? 4- What is your advice to me and to them? I performed Hajj and 'Umrah this year with my first wife, with money shared between us, and mostly she has more than half of this money in maintenance from her own wealth. My second wife did not object to me because she has no money to travel with us. So what is the answer? 1- Do I owe a debt to my second wife for performing Hajj? 2- Is there compensation for my second wife in lodging due to the travel?
A: The obligatory justice between wives is in what a person is able to do, such as financial maintenance, housing, clothing, and lodging. What he is unable to do, such as love and the inclination of the heart, he is not held accountable for; because Allah the Exalted said:[An-Nisa 4:129] And the Prophet (peace and blessings be upon him) used to divide between his wives and say: Mishkat al-Masabih 3235 As for travel, the husband must draw lots between his wives, and whoever the lot falls for
her, he travels with her, just as the Prophet (peace and blessings be upon him) used to do. He does not make up the lodging that occurred during the travel for the others, but rather he divides among them during his presence. Travel for Hajj or 'Umrah is like other travels; drawing lots is necessary in it.
