Q2: What is the ruling if a Christian woman who is married to a Christian man embraces Islam, and after she has publicly declared her Islam she wants to marry a Muslim man, what is the ruling of the Shari'ah in this?
A2: If a woman embraces Islam while she is under a disbelieving man, she becomes forbidden to him, and they are separated, and her waiting period must be observed. If she completes her waiting period before he embraces Islam, she is divorced from him with a minor final divorce; because Allah the Exalted said:
And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for themفَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لاَ هُنَّ حِلٌّ لَهُمْ وَلاَ هُمْ يَحِلُّونَ لَهُنَّ
[Al-Mumtahanah 60:10]
And if he embraces Islam before the end of her waiting period, she is returned to him; because the Prophet (peace and blessings be upon him)
returned the emigrating women to their husbands when they embraced Islam while they were in their waiting periods. If he embraces Islam after the end of the waiting period, he may marry her with a new contract. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
