Fatwa number ( 1218 )
Q: His colleague's job requires constant travel, and he is married and has a friend in whom he trusts and believes in his honesty, and he lives with him, so when he travels, he leaves his wife with him. He asks: Is he sinful for doing this, and what should he do if this action is not permissible?
A: Islam, through its wise and just legislation, aims to preserve the five necessities: religion, life, intellect, wealth, honor, and lineage. Each of these five categories has specific legislation that protects it, removes hardship and difficulty from it, and provides it with matters of improvement that place it in a high station. Among these five categories is honor, which is the abode of lineage. Islam has given it exceptional care, which is evident in the protection of women and the bestowal upon them of garments of modesty, dignity, and awe through the prescription of hijab, and preventing them from displaying their adornment except to those specified in the noble verse. Allah the Exalted said:[An-Nur 24:31]
to the end of the verse. The friend you mentioned is not among those mentioned in the verse; therefore, it is not permissible for a woman to display her adornment before him, nor to be alone with him, whether he is a brother of her husband, a friend, or otherwise. It is established from the Prophet (peace and blessings be upon him) that he said:Mishkat al-Masabih 3102 , and the *hamu* is the husband’s brother, his uncle, and similar male relatives who are not *mahrams* to the wife. And he said: . Accordingly, it is not permissible for a married man to leave his wife with his friend and travel. We were greatly pleased by the questioner’s Islam and his sacrifice for the sake of his religion of his tribe, family, and wealth. We hope that Allah the Exalted will replace his family with a better family, his tribe with a better tribe, and his wealth with more blessed wealth. We remind him
that he has a good example in that, namely the Messenger of Allah (peace and blessings be upon him) and his noble Companions. Indeed, they fled with their religion to Madinah and left their tribes, their families, and their wealth, so Allah the Exalted replaced them with something better than that and made the outcome for them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
