Fatwa number ( 14196 )
Q: A man fornicated with a woman, and she became pregnant. The hadd punishment was not carried out against her because the Shari'ah is not applied in the country. She gave birth, and they later married and had other children besides the first one. The first child grew up and helped the man in his work until they accumulated wealth. The man acknowledged him as his son, and the child acknowledged him as his father. When the man died, they prevented the first child from receiving his share of the inheritance. When he asked for the reason, they said: a child born out of wedlock does not inherit from his parents. Is this correct? What is the sin of the child? It was the two of them who committed the sin, and the hadd was not carried out against them? And what is the saying of Allah the Exalted:[Al-An'am 6:164] ? We thank you greatly.
A: A child born from fornication is attributed to his mother and inherits from her, and she inherits from him, but he does not inherit from the man who fornicated with his mother. If there is a dispute, the matter should be referred to the court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
