Q: He has a brother from his mother who died before his birth, and his mother inherited from him alone, since he was a child of zina. Then his mother died and left no one other than him. He asks: Does he have a right, through inheritance, to what his mother left behind, including what she inherited from her brother?
A: If the matter is as the questioner stated, that his brother who died before his birth was a child of zina, and he died leaving only his mother, then what he left behind is inherited by his mother as an obligatory share. Then, if the questioner’s mother died and her inheritance was restricted to
her son, the questioner, such that she had no husband, no mother, no father, no grandfather, and no grandmother, then all that she left behind, including what she inherited from her previous son, is considered an inheritance right for her son, the questioner. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
