Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the President General from the honorable judge of the Daws Court, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number
(609) and date 29 \ 1 \ 1417 AH. His Excellency asked a question, the text of which is as follows: Ahmad ibn Muhammad ibn Saleh al-Zahrani came to us, stating that he requested a sum of money from a benefactor to build a congregational mosque in one of the villages, and indeed the amount was paid, and he is a supervisor, not a contractor. Then he requested a sum from another benefactor to build a second congregational mosque in another village, and indeed a part of the amount was paid, but the second benefactor did not pay the full amount, and work on the second mosque stopped. He states that he had a surplus from the amount of the previous mosque, so he used the surplus to complete the second congregational mosque; because the second benefactor did not fulfill the completion of the second congregational mosque, and the contractor demanded his right. And he (the one whose name was mentioned previously) requests a fatwa on whether his action is valid or whether he is sinful? And does he return the surplus amount to the previous benefactor or what does he do? Knowing that he is not a contractor and does not have money with which he can complete the second congregational mosque. I hope to be informed about the action of the aforementioned so that I may benefit him with what is required.
After the Committee studied the inquiry, it answered: That his use of the surplus amount from the expenses of the first mosque to complete the construction of the second mosque - there is no harm in it; if the one who donated to the first mosque did not ask for the
surplus amount to be returned to him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
