Q: I obtained (12 visas) to recruit workers from the country of Pakistan , and I submitted them to a recruitment office in that country. That commercial office provided me with housing, food, and a car for free in order to win me over as a client for future occasions. When I selected the workers I had requested, numbering twelve, they paid me a sum of twelve thousand Saudi riyals. When I returned with them to Saudi Arabia , I became doubtful about the permissibility of this amount, as it was my strong suspicion that the owner of the commercial office had taken it from the workers and given it to me to win me over as a client for future occasions. I consulted two of the aforementioned workers, and they absolved me of this amount. As for the remaining ten, some have traveled and I do not know their addresses, and some have passed away while under my sponsorship. I request that this case be referred to His Eminence Shaykh Abdul Aziz ibn Baz to issue a ruling on this matter, and how should I deal with the remaining amount, which is ten thousand, if it is not lawful for me? I conclude thus, and success is from Allah, and may Allah send prayers and peace upon our Prophet Muhammad and upon his family and companions.
A: It is obligatory for you to return the aforementioned amount to the workers. If that is not possible, give it in charity on their behalf; because this amount was deducted from them without right.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
