Ruling on Recruiting Workers and Taking Money for Their Recruitment
Machine translationRead the Arabic original
Your Eminence! A person has a labor recruitment office that brings workers from abroad; however, he takes a sum of money in exchange for bringing this worker. The benefit to the worker is very great, so even if he pays a sum and comes here to work, his benefit will be incomparable to the amount he paid. Is it permissible for the owner of the office to take a sum from the worker in exchange for bringing him here so that he can work, receive salaries, and improve his situation?
First: We advise recruitment offices not to recruit anyone but Muslims: they should not recruit disbelievers, neither from the Christians nor from others.Because the Messenger (peace and blessings be upon him) said: (Expel the Jews and the Christians from the Arabian Peninsula).
And he said in his illness of death: (Expel the polytheists from the Arabian Peninsula).
And he said: (I will expel the Jews and the Christians from the Arabian Peninsula, until I leave no one but a Muslim).
All these are authentic hadiths! And where are we if we stand before Allah (Mighty and Majestic) while we are recruiting these armies and great multitudes of non-Muslims into lands where Islam originated, and which is the refuge of Islam first and last? (Faith returns to Madinah -Meaning: it returns - as the snake returns to its hole).
Therefore: Our land is the origin of Islam and the return of Islam.
Then the Messenger (peace and blessings be upon him) informed and said: (Woe to the Arabs from an evil that has drawn near,It is said: Will we perish while the righteous are among us?He said: Yes.
If the evil becomes abundant) And who are the evil ones?! Do you not read the Qur'an? [At-Tawbah: 28] Everyone other than a Muslim is impure.
So if the evil becomes abundant, whether from the workers or from the work, the people will perish.
So my advice to recruitment offices: They should not recruit anyone but a Muslim.
They may say: Specialization may lie with the disbelievers, and we may not find a Muslim man specialized in this work,Meaning: who masters it! So we say: if we consider this, why would a worker come for agriculture? Or a worker come to be a shepherd? Or a worker come to be in the municipal cleaning? Do Muslims not know this? I am asking you! Is it that the Muslim does not do this well, or does he do it well? He does it well.
In any case, this is my advice to the recruiters, and let them know that Allah will question them on the Day of Resurrection about what they did contrary to His Shari'ah.
Second: They should not recruit unless there is a clear need for this worker: but unfortunately, recruiting workers has now become a trade. One person brings workers in excess of his need by multiples, and he overworks them in the market, and takes a tax from them; so much and so much every month! This is forbidden by the Shari'ah, and contrary to the state's regulations.
As for if these two conditions are met,And they are: that he is a Muslim.
and that he is according to the need.
Then he takes something from him for his recruitment, and if he does not suit him and he returns him, he returns to him what he took, there is no harm; because it is known that there is a three-month trial period between the worker and the recruiter, so if the worker does not suit him, he returns to him what he took, so I hope there is no harm in it.
But if he does not return him, this means that he profited and the poor worker lost, and he may have sold what is behind him and what is below him -as they say- in order to give this amount that the recruiter asked for,Then after he sits for a month or two, it is said to him: Go back, you have nothing.
And I add to this: That some sponsors overwork the sponsored, and take from them the work between them, or perhaps more, then do not give them their wages, and often workers come to us crying; because they are not given wages, and they die of hunger, and they are placed in old buildings, and dozens are crammed into a house that cannot hold half of them, and this is forbidden for the sponsors,Allah (Mighty and Majestic) said in the Holy Hadith: (Three are my adversaries on the Day of Resurrection: a man who gave by Me then betrayed, a man who sold a free man and ate his price, and a man who hired a worker, took full benefit from him, and did not give him his wage).
So my advice to the sponsors: That they fear Allah (Mighty and Majestic) regarding these poor people, and that they give them their right, and do not burden them with more than what was agreed upon in the contract, and let them know that this world is a cycle, so perhaps one day they will be like these workers, going to their lands out of poverty as happened before, where people used to go to India, Syria, and Iraq out of poverty, is it not possible that this state will return? Answer! Yes.
It can return, for Allah is Able to do all things.
So if Allah has blessed us with this blessing now -and praise be to Allah- if we do not thank Him, it will disappear, [Ibrahim: 7].
