Q 2, 3: Is it permissible to take a sum of money in exchange for sponsoring a foreigner? What some contractors do when they bring in a worker and agree with him on a wage of sixty dinars per month, then rent him out to another contractor for ten dinars a day, so the first contractor takes eight dinars and gives the worker two dinars; what is the ruling of Islam on that?
A 2, 3: Regarding the matter of bringing in workers and employing them with someone other than the one who brought them in, and taking a fee for the sponsorship, this issue was previously presented to the Council of Senior Scholars of the Kingdom of Saudi Arabia , and they issued a decision regarding it, the substance of which is as follows:
Praise be to Allah, and may peace and blessings be upon His slave and Messenger Muhammad, and upon his family and companions. After that: The Council examined the issue of bringing in workers and employing them with other than the ones who brought them in, on the condition that the one who brought them in receives a shared portion of their wages, or a known amount from them, based on the numerous repeated questions that reach the General Presidency for Research, Ifta, and Guidance. It reviewed the research prepared by the Permanent Committee for Scholarly Research and Ifta, and after discussion and exchange of opinions, the Council decided that any employment or utilization of the brought-in workers that contradicts what the state has approved for the public interest is prohibited, and that anything the sponsors take from the workers in exchange for enabling them to work with others is considered forbidden; because the Book and the Sunnah have indicated the obligation of obeying the one in authority in what is right, and due to the great corruption and great harm to Muslims that results from employing workers in a manner other than that for which they were brought in, it is obligatory to prohibit it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
