Hajj on behalf of a disbeliever
Machine translationRead the Arabic original
The first question of Fatwa No. ( 2411 )
Q1: The content is that a person did not fast or pray during his life, and he slaughtered for the jinn at trees and stones, as if they were idols for him, and he died a persistent disbeliever in that state. Is it permissible for his relative to perform Hajj on his behalf, or to seek forgiveness for him?
A1: One who dies in the state described in the question is considered a mushrik (one who associates partners with Allah) committing major shirk (associating partners with Allah). It is not permissible to perform Hajj on his behalf, nor to seek forgiveness for him; because of the saying of Allah, the Exalted:[At-Tawbah 9:113] And because it is established that the Messenger of Allah (peace and blessings be upon him) said: Sahih Muslim 976a , narrated by Muslim in his Sahih, and that is because she died in the pre-Islamic age of ignorance (jahiliyyah) on other than Islam. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

It is not for the Prophet and those who have believed to ask forgiveness for the polytheists, even if they were relatives, after it has become clear to them that they are companions of Hellfire.
I sought permission to beg forgiveness for my mother, but He did not grant it to me. I sought permission from Him to visit her grave, and He granted it (permission) to me.
استأذنت ربي أن أستغفر لأمي فلم يأذن لي، واستأذنته أن أزور قبرها فأذن لي
