Q2: I fear Allah and I know that death is a reality that is inevitable, but my mother owns a small house that I rebuilt from scratch. I have a brother who did not participate with me in anything at all, but he angers my mother and father greatly, and he treats them very badly throughout his life until now. He is currently living outside the house, so my mother became angry and decided to write the house over to me. I urged her many times, but she is determined to write it over to me. So I am asking now: Is there a sin on my mother for writing the house over to me and depriving my brother of it, and is there any sin on me if I accept that from my mother?

A2: If the situation is as described, it is not permissible for your mother to give you the house without your brother; due to his saying (peace and blessings be upon him):
Be afraid of Allah, and be just to your children.اتقوا الله واعدلوا بين أولادكم

, and what was reported in its meaning in other hadiths. If she does what was mentioned, she is sinful and you are sinful; because your acceptance of it from her is participation with her in sin and transgression, and Allah (Glorified and Exalted is He) has forbidden that in His saying:
And cooperate in righteousness and piety, but do not cooperate in sin and aggression.وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى وَلاَ تَعَاوَنُوا عَلَى الإِثْمِ وَالْعُدْوَانِ
[Al-Ma'idah 5:2]
, and you must return the gift or give the second son what is equivalent to it. And if you see that she is insistent on not sharing it with you, there is no harm in accepting the gift and giving your brother half of it; to clear your conscience, if she has no children other than the two of you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
