Q: I am a young man in my forty-second year, married for 18 years, and I have four children, three daughters and one son, praise be to Allah. After my father married me off with only a bedroom due to his tight financial circumstances, as he was then a simple grocer, I lived with my father, mother, and brothers in one house. But it was not long before my father isolated me, and I owned nothing but my government salary, and my wife was a housewife with no job. I left my father's house and bought the rest of the household items one by one. I tasted bitterness and hunger, my wife and I. My wife became pregnant and started giving birth, and I was submerged in the whirlpool of life: raising children and completing the furnishings (dishes, utensils, and so on). My father gave me an apartment in the same house, with standing walls but no door, no window, no water, and no electricity. I started finishing it off one by one, and I remained in that state for ten years, and my father knew of me only that I was alive, and did not even ask about me with a word of reassurance. During these ten years, my father's business grew and he became a large, famous wholesaler. He married off my male brothers with top-level household equipment, and finished off an apartment for each son at the highest level. Even my sisters, he married them off with top-level equipment. One day, he offered me to work with him in the shop (his trading store) with my brothers for a monthly wage of (80) eighty pounds, and to give me every year (5) five sacks of rice and barley, and one sack
of wheat, and made me understand that my brothers take the same. So I obeyed him and entered the shop, and that was the beginning of psychological suffering and depression, due to the bad discrimination in treatment, until I came to hate all my brothers. It became clear that I have a brother who does not take a salary as my father said, but takes from the shop what he needs, whether with my father's knowledge or without it. My children ask me: "Is this uncle not your brother?" One day, I was frank with my sisters and my mother that my brother takes from the shop without my father's knowledge, so the world turned upside down, and I became an enemy. When my children grew up and the living conditions improved, I asked my father to increase the salary, but he refused. However, he allowed me to take from the shop what my house needs, whether with his knowledge or without it. And when I am sick, he does not ask about me except as a routine, but when one of my brothers is sick, the world turns upside down. And when I complain of pain in my body during work, he does not listen to me, but when my brothers complain of something minor, he says: "Go, you rest." Knowing that I am their elder brother and the only one who tasted the bitterness of living. And today, the salary and what my father allowed me from the shop is not enough, because my father does not ask about me, neither in school fees, nor in the coming of winter, nor in the coming of festivals. Here I pose my question to your eminence:

However, he allowed me to take from the shop whatever my household needs, whether he knows about it or not. When I am sick, no one asks after me except as a routine, but when one of my brothers is sick, the world turns upside down. If I complain of pain in my body while working, he does not listen to me, but if my brothers complain of something minor, he says: "Go, you rest." Knowing that I am their eldest brother and the only one who has tasted the bitterness of life. Today, the salary and what my father allowed me to take from the shop are not enough, because my father does not ask after me regarding school fees, winter clothing, or holiday expenses. Here I pose my question to your eminence:
Q1: If I take from the shop without my father's knowledge to buy what I need to complete my supply of rice and wheat, and what I need for clothing for myself and my children, is it lawful or forbidden? Q2: Is it my right to demand from my father what I spent to complete the furniture that was supposed to be provided for my marriage, and what I spent on finishing the apartment in my father's house? Knowing that if I ask, he will be angry with me and refuse. Q3: There are some repairs in the apartment, such as plumbing and painting, and if I ask my father, he will refuse. Should I take from the shop without his knowledge to carry out these repairs, knowing that these repairs are for the common benefit of the entire house, since the whole house is one, but each person lives separately?

A: If your father has allowed you to take from the shop what you need for your house, even without his knowledge, as he allowed your brothers, then there is nothing on you regarding what he has permitted. And if your father has helped your brothers in their marriages, it is obligatory for him to help you as he helped them. From al-Nu'man ibn Bashir (may Allah be pleased with him),
His father brought him to Allah's Messenger (ﷺ) and said, "I have given this son of mine a slave, who was belonging to me." Allah's Messenger (ﷺ) asked, "Have you given all your children the like of him?" He replied, "No." Allah's Messenger (ﷺ) then said, "Take him back then."أن أباه أتى به رسول الله صلى الله عليه وسلم فقال: إني نحلت ابني هذا غلامًا كان لي، فقال رسول الله صلى الله عليه وسلم: أكل ولدك نحلته مثل هذا؟ قال: لا، فقال رسول الله صلى الله عليه وسلم: فأرجعه

If you see that your father is short with you compared to your brothers, ask him politely and gently for what he has shorted you, and explain to him that justice among children is obligatory by the Shari'ah. If he is just among you, praise be to Allah, otherwise, it is not permissible for you, given the situation described, to take from his wealth to make the repairs you mentioned without his knowledge. You must be patient in this, perhaps Allah will guide him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
