If an endowment is designated for a specific party, such as the imam of the mosque, and he is paid a stipend, it is not permissible to deprive him of what was designated for him

Fatwa No. ( 218 )
Q: The father owns three houses, each of which yields a surplus of one French riyal per year. One is for breakfast, another for the teacher of the boys who teaches them the Qur'an, and the third is for the mu'adhdhin. Now, the mu'adhdhin and the teacher of the boys are receiving salaries from the government. Should we leave everything
as it was, or should we spend it all on breakfast and charity for the poor?

A: After the Committee studied the question and reviewed the attached document certifying the endowment, and in response to what the questioner asked, the Committee answered as follows: The priority in the produce of these houses is their repair. If there is a surplus, the amount specified in the endowment document for those mentioned by the endower should be paid to them. The fact that the government pays salaries to the mu'adhdhin and the teacher of the boys does not prevent paying them the right specified for them in the document. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
