Fatwa number ( 1409 )
Q: A piece of agricultural land was designated as an endowment (waqf) for the iftar meal in Ramadan only. Then, no one remained to manage the endowment except me. I am an employee in a region far from the town, and there is no one in the town to prepare it for those who break their fast on my behalf. Furthermore, the people of our area work in herding in locations that are difficult for me to know, and they do not gather except on the day of Eid or Friday. Even if I were to prepare it, I would not find anyone to eat it. Is it permissible for me to distribute it as grains to the eligible recipients, or to sell it and buy dates with the proceeds to distribute to the eligible recipients?
A: If the situation is as you described, namely that there is no guardian (wali) for this endowment other than you, that you are unable to prepare it yourself, and that you cannot find someone to take your place in doing so, and that even if it were prepared, there would be no one to eat it in that area, then it is permissible for you to distribute it as grains in Ramadan to the eligible recipients in your country, if possible, or otherwise in the country closest to the location of the endowment. It is also permissible for you to buy dates with its proceeds to distribute them in the same manner.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
