Q: If a man joins the prayer and finds the imam bowing in the air, and all that remains is for him to say: (Hear Allah’s praise from those who praise Him), some say: enter without reciting al-Fatihah, and some say: you must recite al-Fatihah and let the imam pass you.
A: If one enters while the imam is bowing and then bows with him before he rises, he has caught the rak'ah. The basis for this is the hadith of Abu Bakrah al-Thaqafi (may Allah be pleased with him)
he came to the Prophet when he was bowing, so he bowed before joining the row, after which he went to it. He mentioned that to the Prophet, and he said, “God increase your eagerness! But don’t do it again.أنه انتهى إلى النبي صلى الله عليه وسلم وهو راكع فركع قبل أن يصل إلى الصف، فذكر ذلك للنبي صلى الله عليه وسلم فقال: زادك الله حرصًا ولا تعد

narrated by the imam Ahmad and al-Bukhari and Abu Dawud and al-Nasa'i and Ibn Hibban , and this hadith is clear in considering the rak'ah valid; because the Messenger of Allah (peace and blessings be upon him) did not order him to repeat it, and the basis in legislation is generality, and this is what the four imams and the majority of the scholars of knowledge said. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
