Performing the prayer outside its time due to sleeping during the day in Ramadan

The third question of Fatwa No. ( 12542 )
Q3: I have seen people sleeping through the Dhuhr and Asr prayers during the day in Ramadan; because they do not wake up until six thirty, near Maghrib; due to staying up late at night. What is the ruling on fasting in this case? And is it permissible for them to pray it at that same time, or before the Isha prayer?
A3: Prayer is the second pillar of Islam and one of the outward manifestations of the religion, so it is not permissible for a person to sleep through an obligatory prayer, such as Dhuhr or Asr. Allah, Mighty and Majestic, commanded the preservation of the prayers and specifically mentioned the Asr prayer, saying:
Maintain with care the [obligatory] prayers and [in particular] the middle prayerحَافِظُوا عَلَى الصَّلَوَاتِ وَالصَّلاَةِ الْوُسْطَى
[Al-Baqarah 2:238]
which is the Asr. It is established that the Prophet (peace and blessings be upon him) encouraged the Asr prayer, saying:
He who observed two prayers at two cool (hours) would enter Paradise.من صلى البردين دخل الجنة
Sahih Muslim 635a
, and the two colds are: the Fajr prayer and the Asr prayer. A warning was also conveyed regarding the one who misses the Asr prayer, as it is established
that the Prophet (peace and blessings be upon him) said:
Whoever misses 'Asr prayer, it is as if he has been robbed of his family and wealth.من فاتته صلاة العصر فكأنما وتر أهله وماله
Sunan an-Nasa'i 478Sahih (Darussalam)
, and he (peace and blessings be upon him) said:
Whoever leaves the `Asr prayer will have all his (good) deeds annulled.من ترك صلاة العصر حبط عمله
Sahih al-Bukhari 594
. It is obligatory for the one who sleeps through a prayer to pray it immediately after waking up from his sleep. It is also obligatory for him to take the means that help him wake up for the Dhuhr prayer in its time and the Asr prayer in its time, and he must not be lax in this. As for fasting, sleeping does not affect its validity, so the fast of the one who slept during the day in Ramadan is valid. He commits a sin by delaying the prayer if he does not take the means that help him wake up at its time, whether that is an alarm clock or otherwise. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
