Knowing the Rulings from the Evidence Considered Valid in Islamic Law

The third question of the fatwa number ( 4522 )

Q 3: In our city, there are two groups of people: one group cites the noble hadith as evidence for all their statements. The other group: they follow the Maliki school of jurisprudence in all their acts of worship. For example: there are people and young men who raise their hands during the bowing and when rising from the bowing, and they cite the noble Prophetic hadith as evidence for this. As for the others, they do not do this, and they say: that Imam Malik (may Allah be pleased with him) did not do this, and do you know like the Imam of the City of Migration knows? What is your opinion on this issue?

A 3: Praise be to Allah alone, and blessings and peace be upon His Messenger, his family, and his Companions... And to proceed: It is obligatory for the Muslim to know the Islamic rulings from their evidence considered valid in Islamic law, from the Book, the Sunnah, and scholarly consensus, and what is based on them, such as analogical reasoning and the like; if he is qualified for research and independent legal reasoning, otherwise he should ask those he trusts from among the scholars of knowledge and follow them without bias toward any of the independent legal reasoners. And the authentic Sunnah from the Prophet (peace and blessings be upon him) indicates the prescription of raising the hands at the takbir of entering the state of consecration, at the bowing and rising from it, and when standing for the third unit. So it is not permissible to oppose the Sunnah with the statement of anyone. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
