The third question of Fatwa No. ( 1644 ):
Q3: If a father is observant of the five daily prayers and the pillars of Islam, but he believes in the permissibility of making vows and slaughtering animals for the deceased at shrines and mausoleums, is his son present allowed to take from his wealth what he needs to build his future, or to inherit from him after his death, or not?
A3: If a Muslim who is obligated to observe the law believes in the permissibility of making vows and slaughtering animals for the deceased, this belief is major shirk (associating partners with Allah) that expels one from the religion. The holder of this belief is given three days to repent and is treated harshly; if he repents, well and good, otherwise he is killed. As for his son taking from his wealth what he needs to build his future, and inheriting from him after his death, in the specific case asked about, this depends on knowing the reality of the father's situation and the state in which he dies. If his father died holding this belief and it is not known that he repented, then he does not inherit from him; based on the saying of the Prophet (peace and blessings be upon him):
A Muslim may not inherit from an infidel nor an infidel from a Muslim.لا يرث المسلم الكافر، ولا الكافر المسلم
