The first question of Fatwa number ( 5591 ):
Q1: What is the ruling on preaching on the day of the Prophet’s (peace and blessings be upon him) birth?
A1: Enjoining good and forbidding evil, informing people of their religion, and preaching to them in a way that softens their hearts is prescribed at all times; because the command to do so has come in an absolute form without being restricted to a specific time. Allah the Exalted said:
And let there be [arising] from you a nation inviting to [all that is] good, enjoining what is right and forbidding what is wrong, and those will be the successful.وَلْتَكُنْ مِنْكُمْ أُمَّةٌ يَدْعُونَ إِلَى الْخَيْرِ وَيَأْمُرُونَ بِالْمَعْرُوفِ وَيَنْهَوْنَ عَنِ الْمُنْكَرِ وَأُولَئِكَ هُمُ الْمُفْلِحُونَ
[Ali 'Imran 3:104]
, and He the Exalted said:
Invite to the way of your Lord with wisdom and good instruction, and argue with them in a way that is bestادْعُ إِلَى سَبِيلِ رَبِّكَ بِالْحِكْمَةِ وَالْمَوْعِظَةِ الْحَسَنَةِ وَجَادِلْهُمْ بِالَّتِي هِيَ أَحْسَنُ
[An-Nahl 16:125]
, and He the Exalted said, in explaining the state of the hypocrites and the position of the callers to Allah toward them:
(61) And when it is said to them, "Come to what Allah has revealed and to the Messenger," you see the hypocrites turning away from you in aversion. (62) So how [will it be] when disaster strikes them because of what their hands have put forth and then they come to you swearing by Allah, "We intended nothing but good conduct and accommodation." (63) Those are the ones of whom Allah knows what is in their hearts, so turn away from them but admonish them and speak to them a far-reaching word.وَإِذَا قِيلَ لَهُمْ تَعَالَوْا إِلَى مَا أَنْـزَلَ اللَّهُ وَإِلَى الرَّسُولِ رَأَيْتَ الْمُنَافِقِينَ يَصُدُّونَ عَنْكَ صُدُودًا (61) فَكَيْفَ إِذَا أَصَابَتْهُمْ مُصِيبَةٌ بِمَا قَدَّمَتْ أَيْدِيهِمْ ثُمَّ جَاءُوكَ يَحْلِفُونَ بِاللَّهِ إِنْ أَرَدْنَا إِلا إِحْسَانًا وَتَوْفِيقًا (62) أُولَئِكَ الَّذِينَ يَعْلَمُ اللَّهُ مَا فِي قُلُوبِهِمْ فَأَعْرِضْ عَنْهُمْ وَعِظْهُمْ وَقُلْ لَهُمْ فِي أَنْفُسِهِمْ قَوْلا بَلِيغًا
[An-Nisa 4:61-63]
, among other verses. So Allah made the command to do this absolute and did not restrict it to a specific time. Preaching and guidance become more emphasized when there is a cause that necessitates it; such as the Friday sermons and the festivals; because this is established from the Prophet (peace and blessings be upon him), and upon seeing what is wrong; because of his saying (peace and blessings be upon him):
He who amongst you sees something abominable should modify it with the help of his hand; and if he has not strength enough to do it, then he should do it with his tongue, and if he has not strength enough to do it, (even) then he should (abhor it) from his heartمن رأى منكم منكرًا فليغيره بيده، فإن لم يستطع فبلسانه، فإن لم يستطع فبقلبه
Sahih Muslim 49a
. The birth of the Prophet (peace and blessings be upon him) is not among the causes that necessitate specifying that day with an act of worship, or preaching and guidance, or reading the story of the birth; because the Prophet (peace and blessings be upon him) did not specify it with that, and if there had been good in specifying it with that, the Prophet (peace and blessings be upon him) would have been more deserving of it and more eager for it, but he did not do so. This indicates that: specifying it with preaching, or reading the story of the birth, or with any act of worship, is a religious innovation. It is established from the Prophet (peace and blessings be upon him) that he said:
'A'isha reported Allah's Messenger (ﷺ) as saying: He who innovates things in our affairs for which there is no valid (reason) (commits sin) and these are to be rejected.من أحدث في أمرنا هذا ما ليس منه فهو رد
Sahih Muslim 1718a
, and in a narration:
He who did any act for which there is no sanction from our behalf, that is to be rejected.من عمل عملاً ليس عليه أمرنا فهو رد
Sahih Muslim 1718b
. Likewise, his Companions did not do that, and they were the most knowledgeable and most aware of the Sunnah and the most eager to act upon it, may Allah be pleased with them all. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
