The Shaykh : The marriage contract is valid if its conditions are met, which are: the permission of the guardian, the consent of the woman, and two just witnesses. So it is valid.

The questioner : All the conditions were completed.

The Shaykh : But some scholars—especially in Saudi Arabia—exaggerate and hold that the one who abandons prayer is a disbeliever. This is an anomalous opinion that is not correct. That is to say, it can be said regarding the one who abandons prayer that he is an open sinner, but he is not a disbeliever except in one case—may Allah forbid it—if, while he was not praying, he was denying the prayer and denying its prescribed nature.

The Shaykh : I tell you, you just need to listen: If he is denying the prescribed nature of the prayer, then he is a disbeliever and his marriage is not valid.
