Answer:
The correct view is that he should renew the marriage contract if he prays and she does not, or vice versa, if she prays and he does not. He should renew the contract; this is the most cautious and best course of action, based on the saying of the Prophet (peace and blessings be upon him): and his saying (peace and blessings be upon him): Sunan Ibn Majah 1079Sahih (Darussalam).
As for if they both do not pray, the contract is valid. If neither of them prays, the contract is valid.
