The questioner : When the Prophet (peace and blessings be upon him) visited Sa'd ibn Abi Waqqas during the illness in which he died, at the end of the hadith: Sunan al-Bayhaqi 16:416 The Messenger of Allah (peace and blessings be upon him) expressed grief for him because he died in Makkah. Could you please clarify this for us?
The Shaykh : Yes, because the ruling for the first group of emigrants from Makkah to Madinah is that it is not permissible for them to remain in Makkah for more than three days. Therefore, the Messenger of Allah (peace and blessings be upon him) expressed grief for this man because he died in Makkah, whereas it would have been better for him to return to his place of emigration, Madinah, and die there, rather than dying in Makkah. Even though Makkah is the best of lands, as came in the authentic hadith that when the Prophet (peace and blessings be upon him) resolved to emigrate from Makkah to Madinah, he turned toward Makkah and said, may the prayers and peace of Allah be upon him: Even though Makkah is better than all lands, including Madinah, Makkah is better than Madinah. Although Imam al-Suyuti (may Allah have mercy on him) wrote a treatise that went to waste, in which he claimed that Madinah is better than Makkah, the majority of scholars hold that Makkah is better than Madinah. And this is sufficient for you as evidence: However, those who emigrated from Makkah to Madinah are not permitted to return and reside in their original land, which is Makkah, because this would nullify their emigration, which was for Allah (Blessed and Exalted is He). Therefore, it came in *Sahih Muslim* that it is not permissible for an emigrant to stay in Makkah for more than three days. As for this one for whom the Messenger of Allah (peace and blessings be upon him) expressed grief, he did so because he died in Makkah, and it would have been better for him to die in Madinah, but the matter is in the hand of Allah and not in his hand. This is the clarification and explanation.
O Allah, carry out the migration of my companions and do not turn them back on their heels, but the wretched one is Sa'd ibn Khawlah
