The Shaykh : In any case, these endowment lands are not permissible for the trustees to neglect.

The questioner : Yes.

The Shaykh : Those who take charge of them are not permitted to neglect them; rather, it is obligatory for them to care for them properly. If it is possible to utilize them and there is benefit in doing so, then they should be utilized and their benefit taken. Otherwise, they should be sold, and the proceeds should be spent on things that benefit the beneficiaries of the endowment and the endowers.

The questioner : Yes.

The Shaykh : As for leaving them neglected like this, it is not permissible, and it is contrary to the trust that is obligatory upon the one who takes charge of them to fulfill. Then, on this occasion, I would like to clarify to my brother listeners that a person should, if he wishes to make an endowment, make it from things whose benefit is continuous and known, such as building schools, building mosques, repairing roads, and the like, whereby continuous benefit is achieved that does not burden the conscience of those who take charge of these endowments, nor does it lead to their disputes and litigation, as we find in private endowments made for descendants and the like.

The Shaykh : For in them, there arises sometimes litigation, quarreling, and court cases that should not occur between relatives. For this reason, we see that it is better for a person, if he wishes to benefit himself, to spend what Allah has provided for him in his lifetime in useful, continuous matters, as we mentioned first.

The Shaykh : Such as mosques, schools, repairing roads, printing useful books, and the like.
